Yes, they can. Unfortunately when you choose to go to an out of network provider your insurance has no say in what they charge for their services. This is why we exist, so we can mediate the prices and quality services offered to a foreign patient. 

You dont have to hand over YOUR check, theres a reason why its paid to your name. However, if you signed an agreement stating that you would turn in that check, you are obligated by mexican law to do so and they can send you to collection until you clear that debt. Prices on your insurance are based on a schedule fee so the over payment is completely legal.
